1. Agreement to these terms

By accessing or using holohaul.com (the “Site”) or any HoloHaul account or membership (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a membership.

2. What HoloHaul is — and is not

HoloHaul is an independent research and information tool for Pokémon trading-card collectors and investors. We provide card data, estimated market values, grade-worthy “value finder” rankings, and an advanced search tool. All values, prices, ROI figures, and grading estimates are informational research only and are not financial, investment, or grading advice, and are not a guarantee of any price, sale, grade, or outcome. Card prices are volatile and grading results vary. You are solely responsible for your own buying, selling, and grading decisions; always verify with primary sources (e.g. recent eBay sold listings) before acting. See also Section 9 (Disclaimers).

3. Accounts

You are responsible for the accuracy of your registration information, for keeping your password secure, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Membership, billing, and renewals

  • Membership is offered on a recurring subscription basis at $9.99 per month (or other prices shown at checkout), billed in advance.
  • Payments are processed by our third-party payment processor, Stripe. We do not store your full card details. By subscribing you also agree to Stripe’s terms.
  • Your membership automatically renews each billing period until cancelled. You authorize us (via Stripe) to charge your payment method on each renewal.
  • We may change pricing or features on a prospective basis; we will give reasonable notice of price changes, which take effect at your next renewal.
  • Cancellation and refunds are governed by our Refund & Cancellation Policy, which is incorporated into these Terms.

5. Acceptable use

You agree not to: (a) scrape, harvest, bulk-download, resell, or redistribute the Service’s data or content except as expressly permitted; (b) share your account or membership access with others; (c) circumvent paywalls, rate limits, or access controls; (d) interfere with or disrupt the Service; (e) use the Service to violate any law or third-party right; or (f) use automated systems to access the Service except as we permit. We may revoke access for misuse.

6. Intellectual property

The Site’s original content, design, software, editorial writing, and compilations are owned by HoloHaul or its licensors and are protected by law. We grant you a limited, personal, non-transferable license to use the Service for your own non-commercial research. Card data and images may be sourced from third-party APIs and remain the property of their respective owners.

7. Third-party data and trademarks

Pokémon and related names, characters, and card images are trademarks and copyrights of Nintendo, The Pokémon Company, Creatures Inc., and GAME FREAK. PSA and other grading marks are the property of their respective owners. HoloHaul is independent and is not affiliated with, endorsed by, sponsored by, or associated with Nintendo, The Pokémon Company, PSA, or eBay. Trademarks are used only for identification and informational purposes (nominative fair use).

8. Data sources and accuracy

Card attributes and images are drawn from the Pokémon TCG API; pricing is derived from third-party sold-listing data and presented as estimates. We do not warrant that any data is accurate, complete, current, or error-free. Features and data availability may change or be discontinued at any time.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY VALUE, PRICE, OR GRADING ESTIMATE WILL BE REALIZED. NOTHING ON THE SERVICE IS FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOLOHAUL AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR LOSSES ARISING FROM YOUR PURCHASE, SALE, OR GRADING DECISIONS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless HoloHaul and its operators from claims arising out of your misuse of the Service or violation of these Terms or any law or third-party right.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may stop using the Service and cancel your membership at any time per the Refund & Cancellation Policy. Sections that by their nature should survive termination (e.g. 6, 9, 10, 11, 13) will survive.

13. Changes; governing law; contact

  • We may update these Terms; material changes will be posted with a new effective date and, where required, notified to members. Continued use after changes means you accept them.
  • These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws rules, and you and HoloHaul submit to the courts located in Pennsylvania for any dispute not otherwise resolved.
